Overview
Plaintiff, a 63-year old white man, alleged that his employer's DEI policies that "focused on promoting the inclusion of non-white workers and female workers in the workforce" led to his termination.

Plaintiff also alleges that his age was a motiving factor in his termination. To support his claims that he was discriminated against, Plaintiff asserted that he was replaced by a woman under 40 years old with less experience and lower qualifications than him.
On January 16, 2024, Defendant filed a for asserting that the evidence in the case did not support his discrimination claims and that he was fired due to not having the required competencies after the reorganization of the sales department. On March 26, the court granted Defendant's motion for summary judgment because Plaintiff was unable to prove that the reason Defendant gave for his termination was just a pretext (made-up excuse).

On April 25, 2025, the court of appeals reversed the lower court's decision on Plaintiff's gender discrimination claim and affirmed the age and race claims. For the gender discrimination claim, the court concluded that Defendant's reasons for terminating Plaintiff were inconsistent due to positive annual reviews, minimal concerns about Plaintiff's performance prior to termination, and a company strategy that could be seen as a goal to increase the number of women managers.
