Overview

Plaintiff, a 63-year old white man, alleged that his employer's DEI policies that "focused on promoting the inclusion of non-white workers and female workers in the workforce" led to his termination.

Details

Plaintiff the district court's decision to grant Defendant's and dismiss the case on Plaintiff's claims of age, gender, and race discrimination against his former employer.

On April 25, 2025, the court of appeals reversed the lower court's decision on Plaintiff's gender discrimination claim and affirmed the age and race claims. For the gender discrimination claim, the court concluded that Defendant's reasons for terminating Plaintiff were inconsistent due to positive annual reviews, minimal concerns about Plaintiff's performance prior to termination, and a company strategy that could be seen as a goal to increase the number of women managers.

On May 9, 2025, Plaintiff filed a petition for partial panel rehearing in order to reconsider the age discrimination claim. On May 19, the court denied the request.
