Overview
Plaintiff, an attorney, challenged the constitutionality of the requirement to pay Wisconsin Bar membership dues to fund a Diversity Clerkship Program.
Details
Plaintiff alleged that the Diversity Clerkship Program was unconstitutional for discriminating against applicants based on race and that the requirement to pay bar dues violated his free speech rights by forcing him to fund the activities.
The parties settled the part of the case relating to the Diversity Clerkship Program after Defendants agreed to make clear that the program was open to all students regardless of identity and to define diversity as "including people with differing characteristics, beliefs, experiences, interests, and viewpoints."
Plaintiff then filed an amended challenging the Bar's "Leadership Development Summit" and "Leadership Academy" for being racially discriminatory and violating his free speech rights. Defendants filed a motion to dismiss the amended complaint. On August 19, 2024, the court removed three of the individual defendants from the suit, but otherwise allowed the suit to continue.
On June 23, 2025, the court extended all remaining case deadlines so that both parties can continue settlement discussions.
On July 15, 2025, the parties reached a settlement and will dismiss the case once the terms of the settlement are completed.
