Overview
Plaintiffs, who receive federal funding from AmeriCorps, are challenging new grant rules that not only require compliance with President Trump’s DEI-related executive orders but may go even further by banning all DEI activities, including those that don’t violate anti-discrimination laws.
Details
For over ten years, Plaintiffs (the San Francisco Unified School District and the City of Santa Fe) have received grant funding from AmeriCorps to support programs serving vulnerable students, seniors, and other community members.
On March 11, 2025, Plaintiffs asked the court for a preliminary injunction and temporary restraining order (TRO) to stop AmeriCorps from enforcing these new conditions on the grants while the case continue in court. AmeriCorps opposed this request.
On March 31, 2025, the court granted the TRO request to halt the enforcement of the new conditions after finding that Plaintiffs demonstrated: 1) a likelihood of success on the merits; 2) a likelihood of suffering irreparable harm; 3) that they would face greater hardship if the injunction were denied than Defendant would if it were granted; and 4) that the injunction serves the public interest.
On June 18, 2025, the court granted Plaintiffs' request for a preliminary injunction, which will continue to halt AmeriCorp's enforcement of the new grant conditions. In doing so, the court applied the same reasoning for granting the TRO in March.
