CASE NAME
Pumariega v. Basis Technologies, Inc.
Overview
Plaintiff, a devout Christian, alleges that his former employer fired him because of his religion after he objected to various DEI trainings and activities.
Details
Plaintiff sought an accommodation to skip DEI trainings after attending a training on LGBTQ+ issues that discussed topics he considered to be in conflict with his Christian beliefs. He also objected to a planned LGBTQ+ Pride Month event.
On October 21, 2024, the court partially granted and partially denied Defendant's motion to dismiss. The court noted that at this early stage of a motion to dismiss, Plaintiff does not need to make out a case of discrimination; he just needs to allege that he was subjected to an adverse employment action because of his religion. Here, he alleges that the company knew about his Christian beliefs and fired him days after he complained about DEI training on that basis and requested an accommodation. The court found that such an allegation is enough to allow the claim to proceed.
