Details
Plaintiff argued that his employer's use of Key Performance Indicators and other metrics to meet the company's goal of hiring more women, and its practice of making bonus amounts depend in part on whether that goal was reached, was unlawful sex discrimination. Defendant, BHP, argued that its DEI initiative and gender-balance goal were aspirational and did not constitute unlawful discrimination.
Court denied Defendant's motion for summary judgment, allowing the case to proceed to trial. However, the parties settled out of court.
