Defendant asked the court to dismiss the case, arguing that Plaintiff's claims were moot because the BIPOC At-Large position had been eliminated and replaced by the "Racial Equity At-Large" position, which is open to all union members regardless of racial or ethnic background. Defendant further argued that Plaintiff's claim for punitive damages should be dismissed, as Plaintiff had not shown that Defendant acted with knowledge that its actions were unlawful.

Defendant made an Offer of Judgment to Plaintiff, agreeing to have judgment entered against it and to pay Plaintiff $12,000 plus attorneys' fees. Plaintiff accepted the offer, and the court subsequently entered judgment against Defendant.
