Details

Petitioners argue that the rule compels broadcasters to "categorize employees on the basis of race, ethnicity, and sex" and "pressures them to engage in race- and sex-conscious employment decisions," in violation of the Equal Protection Clause. Petitioners also argue that the rule violates the First Amendment by "compelling controversial speech."

On May 19, 2025, the court issued an opinion that stated that the FCC lacked statutory authority to require disclosures, and that requiring disclosure and publication violated Petitioners' First and Fifth Amendment rights. As a result, the court vacated the FCC's order.
