CASE NAME
Loeffler v. International Business Machines Corporation a/k/a IBM et al
Overview
Plaintiff, a 64 year old white man, alleges that Defendant (IBM) terminated him due to his race, sex, and age despite his positive reviews and high performance in an effort to meet its diversity goals.
Details
Plaintiff asserts that IBM's DEI policy ties executive bonuses to their ability to reach certain numerical goals regarding underrepresented minorities and genders in the company. In support of this assertion, he cited an interview of IBM's CEO and the company's 2020 Diversity Report that included statements about how bonuses and threats of termination were used to hold leadership accountable to DEI goals. Plaintiff alleges that these factors motivated his supervisor to place him on a pretextual Performance Improvement Plan that resulted in his termination.
