Plaintiff, a white man, brought a discrimination claim against his former employer, claiming that he was fired to advance the employer's diversity goals.

Details

At trial, Plaintiff provided evidence that Defendant’s diversity and inclusion plan included financial incentives in the form of executive bonuses if certain representation targets for specific racial groups were achieved within a set time period. Additionally, Plaintiff showed that in spite of a consistent record of high performance, his termination was given without notice or a clear reason. Lastly, Plaintiff provided evidence that shortly after his termination he was replaced by three women (two were also racial minorities). 

A jury returned a verdict finding that Plaintiff had proven that his race and/or sex were motivating factors in Defendant's decision to terminate his employment. The court held there was sufficient evidence for a reasonable jury to reach this verdict. However, it reduced the jury award of punitive damages from $10 million to $300,000.

Defendant appealed the jury verdict.
