Plaintiff appealed the District Court's decision to dismiss their complaint against Amazon's “Delivery Service Partner” (DSP) program and its diversity grants.
Details
Under the program, eligible Black, Hispanic, and Native American DSP owners receive a monetary stipend of $10,000 to assist with startup costs.
The court below decided that Plaintiff lacked standing, because she refused to apply to the DSP program and thus lacked an injury. The court found that Plaintiff would not necessarily be denied any contractual benefit due to her race unless she was first accepted into the DSP program, which at this point was speculative.
On March 26, 2025, the Court of Appeals dismissed the case after Plaintiff withdrew her appeal.
